Brian Lahti
Brian E. Lahti, who has provided legal counsel across the country, believes in conducting lawsuits and counseling clients by understanding the business end-goals and knowing the actions needed to achieve those goals.
Lahti practices complex commercial and IP litigation at the trial and appellate levels. He has tried cases to juries and arbitrators. Lahti has also successfully defeated claims at the summary judgment stage and defended those judgments at the appellate level. He has a deep background in a multitude of related areas, enabling Lahti to issue-spot quickly and generate winning strategies for his clients. Lahti has represented clients-ranging from startups to Fortune 500 companies-in patent, trade secret, trademark, unfair competition, defamation, First Amendment, securities, contract, partnership and corporation disputes, and real property matters. He also counsels clients on compliance and defends against claims relating to the Americans with Disabilities Act (ADA).
Lahti also routinely provides counsel to his clients related to intellectual property, corporate structure, and business strategy. He is the architect of offensive patent enforcement strategies, allowing clients to assert claims of patent infringement against competitors and obtain successful business outcomes. Lahti has a specific passion for representing and providing counseling to wineries. He has been awarded Wine & Spirits Education Trust Level 2 with Merit.
Lahti’s expertise and counseling has resulted in favorable verdicts and outcomes, notable among them:
- Obtaining a jury-verdict awarding over $900,000 after a two-week trial in a complex business dispute;
- Defeating claims of trade secret misappropriation and related temporary restraining order at the motion to dismiss stage;
- Obtaining case-ending sanctions and $1.3 million judgment against parties that had attempted to use altered documents in court; and
- Successfully defending a complete positioning solutions company against claims of patent infringement that was affirmed by the Federal Circuit; and
- The successful defense of a financial institution and its officers against two securities class action lawsuits.
Lahti also has represented companies in Foreign Corrupt Practices Act investigations and in responding to FINRA requests and FINRA arbitration. Lahti has additional, yet confidential, successes and settlements.
Lahti previously was an associate at an AmLaw 100 law firm for over 5 years. He has also advocated and lobbied for patent reform, with Lahti’s efforts being published and cited on the floor of the U.S. Senate. Lahti has been a guest lecturer at his alma mater on the subject of successful deposition techniques for taking and defending a deposition in civil litigation. Lahti has been included on the list of Mountain States Rising Stars in Super Lawyers, an honor given to only the top 2.5% of attorneys practicing in the Mountain States (Utah, Nevada, Montana, Idaho, and Wyoming) under the age of 40 or practicing law for less than 10 years. While Lahti was in law school at the University of California, Berkeley, School of Law, he was an Articles Editor for the Berkeley Technology Law Journal, as well as a teaching assistant for Civil Procedure and Appellate Advocacy.
